11. Log Files

We also store your IP address against each order placed on our site to help combat fraudulent transactions. 16. Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any 'Act of God', terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or manmade eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. 17. JachOOs® as Reseller or Licensor

JachOOs® may act as a reseller or licensor of certain third party services, hardware, software and equipment used in connection with the Services ("Non-JachOOs Products"). JachOOs® shall not be responsible for any changes in the Services that cause any Non-JachOOs® Products to become obsolete, require modification or alteration, or otherwise affect the performance of the Services. Any malfunction or manufacturer's defects of Non-JachOOs Products, either sold, licensed or provided by JachOOs® to you will not be deemed a breach of JachOOs® obligations under this Agreement. Any rights or remedies you may have regarding the ownership, licensing, performance or compliance of any Non-JachOOs Product are limited to those rights extended to you by the manufacturer of such Non-JachOOs Product. You are entitled to use any Non-JachOOs Product supplied by JachOOs® only in connection with your use of the Services as permitted under this Agreement. You shall make no attempt to copy, alter, reverse engineer, or tamper with such Non-JachOOs Product or to use it other than in connection with the Services. You shall not resell, transfer, export or re-export any Non-JachOOs Product, or any technical data derived therefrom, in violation of any applicable law, rules or regulations.

18. JachOOs® Cloud Platform Services

JachOOs® act as a reseller or licensor of providing cloud hosting platforms from the major brands like Google Cloud Compute, Microsoft Azure, Amazon Web Services and DigitalOcean. JachOOs® shall not be responsible for any changes in the services that cause any of these cloud platforms to become obsolete, require modification or alteration, or otherwise affect the performance of the Services. Any malfunction or manufacturer's defects of Non-JachOOs hosting platforms, either sold, licensed or provided by JachOOs® to you will not be deemed a breach of JachOOs® obligations under this Agreement. Any rights or remedies you may have regarding the ownership, licensing, performance or compliance of any Non-JachOOs hosting platforms are limited to those rights extended to you by the cloud platform providers of such Non-JachOOs services. You are entitled to use any Non-JachOOs cloud hosting or domain services supplied by JachOOs® only in connection with your use of the Services as permitted under this Agreement. You shall make no attempt to copy, alter, reverse engineer, or tamper with such Non-JachOOs domain or hosting platforms or to use it other than in connection with the services. You shall not resell, transfer, export or re-export any Non-JachOOs® hosting platforms, or any technical data derived therefrom, in violation of any applicable law, rules or regulations.

TERMS AND CONDITIONS FOR LEGAL OPERATIONS IN UNITED ARAB EMIRATES

JachOOs [DataWave Technologies LLC] operates the website of jachoos.net(the "Site") in UAE. The following are the terms of use regulating Site use ("Terms of Use"). By using the Site, you expressly agree to be bound by these Terms of Use and the privacy policy of jachoos.com and to abide by these Terms of Use and any applicable laws and regulations governing the use of the Site. DataWave Technologies LLC reserves the right at any time to change these Terms of Use, effective immediately upon posting to the Site. Please review this page from time to time. 1. SITE OPERATION: Our country of domicile is United Arab Emirates. DataWave Technologies LLC manages this Site from the U.A.E. DataWave Technologies LLC gives no statement that this Site is appropriate for use elsewhere. You are responsible for ensuring compliance with local laws when accessing this Site from other locations. In violation of any applicable laws or regulations, including but not limited to any U.A.E. export laws and regulations, you may not use, export or re-export any materials from this Site.

2. APPLICABLE LAW. The Terms and Conditions shall be construed in accordance with the federal laws of the United Arab Emirates, without regard to conflict of law principles. All disputes arising thereby shall only be heard only by a court of competent jurisdiction in U.A.E.

3. MULTI-CURRENCY PRICED TRANSACTION, the displayed price and currency selected by you, will be the same price and currency charged to the Card and printed on the Transaction Receipt.

4. PURCHASES. DataWave Technologies LLC accepts payment for its products and services through Visa, Mastercard, Diners Club, Discover debit and credit cards, WeChat Pay and Alipay in (AED and USD). In addition, all online transactions are subject to the terms and conditions of the respective merchant service providers. Please check the user agreement and privacy policy of the respective merchant service provider prior to entering any transaction. Interpretation. These Terms of Use supersede all other written and oral communications or agreements concerning the topics discussed in the Terms of Use. A waiver or modification to these Terms of Use would only be valid if it is performed in writing by a DataWave Technologies LLC appointed officer. All refunds will be made onto the original mode of payment.

5. OFFICE FOREIGN ASSETS CONTROL (OFAC) SANCTIONED COUNTRIES. DataWave Technologies LLC will not trade or provide services to individuals and companies owned or controlled by or acting on behalf of targeted OFAC countries AND individuals, groups and entities, such as terrorists and narcotics traffickers designated under OFAC programs that are not country-specific.

6. REPRESENTATIONS WITH YOU. LICENCE GRANTED TO YOU. By providing materials to JachOOs (DataWave Technologies LLC), including by submitting or uploading content or materials for use on the Site you represent and warrant that you or the owner of all rights to such content or materials has expressly granted JachOOs (DataWave Technologies LLC) an irrevocable world-wide right in all languages and in perpetuity to use and exploit all or any part of the content and materials provided by you. Delivery Policy

(JachOOs Services) – Payment Confirmation. The customer will be acknowledged by a confirmation email once we receive the payment. The order will be processed after receiving the payment and will be informed to the customer by email. Customers will receive an email with user accounts for any hosting products.

Billing

The entire billing operations related to the services provided will be handled at our registered office in UK and will be in accordance with the laws of the country. Any legal formalities related to billing will also be handled within the same jurisdiction.

Refund Policy

We'll give you a refund if you cancel within the first thirty days. However, bank charges may apply. The refund for cancellations after 30 days will be subjective to company policies and refund will be made through the original mode of payment. JachOOs (DataWave Technologies have full rights to accept or decline the refund based on case to case. We issue a refund for the balance amount after deducting the charges for the period of use. Domain registration charges are not refundable, you can use it until the end of the registration period or you can transfer to another provider at any time until the expiry.

Cancellation Policy

Cancellations are accepted at any time and the accounts may get immediately closed, depending on the products and services. Refund for the services will be processed according to the refund policy only.
